SNORKELING & BOAT TRAVEL

LIABILITY RELEASE AND ASSUMPTION OF RISK

This is a Liability Release and Assumption of Risk Agreement that releases your rights to sue RR Tours LLC and any of its subsidiaries or related entities, including but not limited to its principles, directors, officers, servants, agents, landlords, contractors and/or employees (hereinafter collectively referred to as "Released Parties") for personal injuries or wrongful death that may result from negligence of the Released Parties (whether active or passive), while taking part in-water and boating activities.

I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH SNORKELING, IN-WATER ACTIVITIES AND BOATING ACTIVITES, including, but not limited to, equipment failure, perils of the sea, harm caused by marine creatures (including bites), acts of fellow disembarking boats, and activities on the docks and I HEREBY ASSUME SUCH RISKS.

I UNDERSTAND THAT I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.

I represent that I am physically fit to snorkel, swim, participate in water-related activities, and ride on a boat, and I will not hold the Released Parties responsible if I am injured as a result of ANY incidents (medical, accidental, or otherwise) which occurs while snorkeling, swimming, floating in the water, riding on the boat, or otherwise participating on this boat trip, whether said incident occurs in the water, on the boat, or while embarking or disembarking the boat at the dock.

I also understand that sea conditions may change while we are traveling in open water, or while stopped to engage in any in-water activities, an that such changes are a function of the environment. I will not hold the Released Parties responsible for weather/sea conditions over which they have no control.

I further will not hold the Released Parties responsible for any injury or death that could result from interaction with marine life or other wildlife that may be encountered while taking part in these water activities and boat excursions. 

​

For snorkeling and swimming activities, I acknowledge that I will be provided with a flotation device and I will not remove my flotation device at any time while in the water. I acknowledge that doing so will constitute a violation of safety rules and procedures for which I expressly assume the risk. 

​

While snorkeling or swimming, if I become distressed while in the water, I will immediately inflate my flotation device for floatation assistance. 

​

I fully understand that the involved boat has limited medical facilities and that in the event of illness or injury appropriate medical care must be summoned by radio and treatment will be delayed until I can be transported to a proper medial facility. I agree in advance to these conditions. 

​

The Released Parties have made no representation to me implied or otherwise that they or their crew can perform safe rescues or render first aid. In the event I show signs of distress or call for aid I would like assistance and will not hold the Released Parties, their crew, boats or passengers responsively for their actions in attempting the performance of rescue or first aid. 

​

I understand and agree that the staff of the Released Parties may take photographs or video of me participating in activities while on Released Parties premises or vessel(s). I fully consent and agree that these images may be published by the Released Parties on Social Media or in any other form of media without further permission from me. I hereby waive all claims against the Released Parties for compensation for the publication of my image, and I do so on behalf of myself, my heir and assigns.

I understand and agree that I am not only giving up my right to sue the Released Parties but also any rights to my heirs, assigns or beneficiaries may have to sue the Released Parties resulting from my death. I further represent that I have the authority to do so and my heirs, assigns  and beneficiaries will be estopped from claiming otherwise because of my representation to the released Parties.

I further state that I am of lawful age and legally competent to sign the Agreement, or that I have obtained the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. The remainder of this Agreement will then be construed as though the unenforceable provision had never been contained herein.

IT IS MY INTENTION BY THIS INSTUMENT TO GIVE UP MY RIGHT TO SUE ALL PERSONS OR ENTITIES REFERRED TO HEREIN, WHETHER SPECIFICALLY NAMED OR NOT, AND IT IS ALSO MY INTENTION TO EXEMPT AND RELEASE ALL RELEASED PARTIEIS AND TO HOLD THESE ENTITIES HARMLESS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR GROSS NEGLIGENCE AND I ASSUME ALL RISK IN CONNECTION WITH SNORKELING, IN WATER AND BOATING ACTIVITIES, INCLUDING BUT NOT LIMITED TO THE MAINTENANCE OF THE EQUIPMENT OR ORGANIZATION OF THIS ACTIVITY.

I have carefully read this contract in its entirety, fully understand its contents, and agree to the Terms and conditions of this contract on behalf of myself, my heirs, and my personal representatives. This document constitutes the final and entire agreement between Released Parties and the undersigned. There are NO WARRANTIES expressed or implied, which extend beyond the description of the activity listed on this form. THIS IS A COMPLETE RELEASE OF LIABLITY AND LEGALLY BINDING CONTRACT.
